Trial Monitoring
This is likely for your corporate and carrier clients. A local trial monitoring counsel would have the ability to observe and report on the trial, and your client doesn’t have to pay for hotels, meals, etc. The counsel and your client design and spec out the report on the front end to meet their specific needs. The value-add to the client is that the local counsel is likely to know the judge, jurisdiction, etc. better than utilizing typical panel counsel and is likely to give more insight at a more cost-effective pricing structure.

For higher-end or larger-stake cases, an “uber black” list of trial monitoring counsel could be generated. I’m conceptualizing this as a group of highly qualified attorneys who are available for more national work (more akin to panel counsel’s role currently). However, given technology, the attorney doesn’t necessarily need to be in the courtroom, but could live stream the real-time court reporting to keep costs reasonable. (I do think this would be more difficult in a jury trial, as part of what trial monitoring counsel would be evaluating is a jury’s reaction.) But I know this is the “new space” to play in, and I see opportunities in it.

Appellate Preservation Counsel
This would be similar to the trial monitoring role above, but the attorney would be preserving the record rather than providing an objective report (i.e., assisting in objections, helping with jury instructions, etc.). This is where I think live streaming real time reporting can really be utilized. By way of example, if I am solely concerned with how the record will look on appeal, being physically in the courtroom is not always necessary (and at times can be misleading). All that is necessary is effective communication between the appellate and trial counsel.

Appellate Evaluation and Prosecution Counsel
Finally, this idea is more traditional – Vortex could provide a list of regional counsel available to evaluate and prosecute appeals. The “local factor” here is important – in most state appellate courts, having a “local” argue your appeal lends far more credibility and value than bringing in a national or out-of-town firm (federal court, in my experience, is a bit different). The service could be two-fold: (a) trial record evaluation to advise on whether to appeal or not and (b) actual drafting and prosecution (or defense) of the appeal. Here’s your sales pitch for your in-house clients: imagine if you could get one or two appellate counsel spun up on a legal issue the client wants to change – and then all the client’s trials are vetted by the same appellate counsel to determine whether an appeal will advance that change. Far more efficient than having the in-house attorney try to manage such a venture, or having several different counsel in the mix.
